Terms of Service

1. Acceptance of Terms

By creating an account or using the Mosiaq application ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the Service.

2. Description of Service

Mosiaq is a peer-to-peer puzzle exchange platform that enables users to list, browse, and swap jigsaw puzzles using a points-based economy ("Loop Points"). Mosiaq does not own or sell puzzles; it provides the infrastructure for members to exchange puzzles with one another.

3. Eligibility

You must be at least 18 years old to create an account. By using the Service, you represent that you meet this requirement.

4. Loop Points Economy

4.1 Earning Points

  • Users receive Loop Points when they list a qualifying puzzle on the platform.
  • Points are non-transferable between accounts and have no cash value.

4.2 Spending Points

  • Points are debited when you accept a swap offer. The exact amount is shown before acceptance.
  • If a swap is cancelled before shipment, points are refunded automatically.

4.3 Point Adjustments

  • Mosiaq reserves the right to adjust Loop Points balances for fraud, abuse, or system errors.
  • Negative balances may result in account suspension.

4.4 No Cash Value

Loop Points cannot be redeemed for cash, transferred to other users, or exchanged for anything outside the platform. Points expire if your account is closed.

5. Listings, Swaps & Catalog

5.1 Listing

By listing a puzzle, you represent that: (a) you own it, (b) it is complete to the best of your knowledge, (c) the images you provide are accurate.

5.2 Swapping

Once a swap is confirmed, the provider is responsible for packaging and shipping the puzzle within 5 business days. Failure to ship may result in automatic cancellation and a strike against your account.

5.3 Condition Expectations

Puzzles are expected to be in the condition shown in listing photos. Material misrepresentation (wrong item, damaged, missing pieces) may be disputed under Section 7.

5.4 Catalog Suggestions

If the puzzle you want to list is not yet in our catalog, you may submit a catalog suggestion that includes details such as title, brand, piece count, an image, and other information. Suggestions are reviewed by Mosiaq administrators before they are added to the shared catalog. By submitting a suggestion you represent that the information is accurate and that you have the right to share any image you provide, and you grant Mosiaq a non-exclusive, royalty-free license to use, edit, and display that content as part of the catalog. We may approve, edit, or reject suggestions at our discretion; you may be notified of the outcome. Approved entries become part of the shared catalog available to all members and are no longer specific to you.

6. Shipping

Shipping is facilitated through the United States Postal Service (USPS). Using the USPS APIs, the platform generates prepaid shipping labels, can schedule carrier pickup from the provider's address, and provides delivery tracking for your swaps. If you do not have a printer, you may opt to have USPS deliver a printed label to your address (Label Delivery Service) for a fee disclosed at the time (see Section 8). Users are responsible for properly packaging puzzles. Mosiaq is not a carrier and bears no liability for carrier delays, damage in transit, or lost packages.

7. Dispute Resolution

7.1 Filing a Dispute

The requester (recipient) may file a dispute within 7 days of the delivery date. Disputes must specify a reason: wrong item, missing pieces, damaged, not received, or other.

7.2 Admin Review

Mosiaq administrators will review evidence submitted by both parties and resolve disputes within 5 business days. Decisions may result in:

  • Refund to requester: swap is cancelled, Loop Points are returned.
  • Dismissal: swap is marked complete, no refund issued.

7.3 Finality

Admin decisions are final. Mosiaq is not responsible for the physical return of items once a dispute is resolved.

7.4 External Disputes

These Terms do not limit any rights you may have under applicable consumer protection laws.

8. Payments and Stripe

Certain features require payment via Stripe, including Loop Points top-ups (purchasing additional Loop Points), shipping charges when you do not have enough Loop Points to cover a swap, and the optional USPS Label Delivery Service fee. Pricing is shown before you confirm any payment. By using these features, you agree to Stripe's Terms of Service. Mosiaq does not store your payment card details.

9. Prohibited Conduct

You agree not to:

  • Create multiple accounts to circumvent restrictions ("Sybil attacks").
  • Misrepresent the condition or ownership of puzzles.
  • Manipulate the points economy through fraudulent listings or swaps.
  • Use the platform for commercial resale.
  • Harass, threaten, or abuse other users.

Violations may result in account suspension, points forfeiture, or permanent ban.

10. Account Termination

Mosiaq may suspend or terminate your account at any time for violation of these Terms. You may close your account at any time by contacting support. Closure forfeits any remaining Loop Points.

11. Intellectual Property

The Mosiaq name, logo, and software are owned by Mosiaq and may not be reproduced without permission. User-submitted content (photos, descriptions) remains your property; you grant Mosiaq a non-exclusive license to display it within the Service.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS." MOSIAQ DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. MOSIAQ DOES NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOSIAQ'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE LESSER OF (A) THE AMOUNT YOU PAID TO MOSIAQ IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $100 USD.

MOSIAQ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA OR PROFITS.

14. Indemnification

You agree to indemnify and hold Mosiaq harmless from any claims, losses, damages, or expenses (including reasonable attorney fees) arising from your use of the Service, your content, or your violation of these Terms.

15. Governing Law

These Terms are governed by the laws of the State of Washington, USA, without regard to conflict-of-law principles. Any disputes shall be resolved in the state or federal courts located in Washington.

16. Changes to Terms

Mosiaq may update these Terms at any time. We will notify you via the app. Continued use after notification constitutes acceptance of the updated Terms.
